The topic of copyright is interesting for many people, especially for those who have created logos with similar services like Logaster. So let us review this topic in more detail.
Before we start, we want to note that this post is not legally exhaustive; it only explains the general principle of copyright using “simple and human” language.
What kind of copyright does Logaster grant to the customer?
“A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a “derivative work”.”
Logaster cannot be responsible for the third party; we cannot guarantee that someone else will not have a similar emblem in their logo.
Which logos are available for copyright?
Logos usually consist of an icon and text (name of company, site, etc.). You will get logo copyright if you create each element of the logo independently. Or someone will do it for you and give you all the rights to the logo. The logo can be 100% unique, if all elements are created from scratch.
How unique are icons on the Logaster site?
Our icons are drawn by illustrators and can be taken from public sites. Most of the icons are available only on our site, and some can be found on other sites, too. There is no 100% guarantee that someone else will not use the same icon (read more here, points 9,15,16).
How much should a unique logo cost?
Design studios, designers, and freelancers can offer a 100% unique icon with original font (other ways of logo creation are described in this article). It takes a lot of time and therefore money. It’s expensive, but it doesn’t always protect you from plagiarism example1, example2.
If you choose a cheaper way to create a logo, you will pay a much lower price (money and your time), but the uniqueness of your logo will suffer.
What should I do if I need a 100% unique logo with supporting documents?
According to the law, what makes a logo unique is the combination of the symbol with the company name, its colours, and their spatial relationship. Therefore, as we have already mentioned above, when you create the logo out of the prefabricated elements, you create a new unique logo.
In different countries, there are different nuances of the legislation. Therefore, we recommend you consult with your local lawyer.
At the very least, use a created logo as a prototype or draft. Give it to a freelancer or a designer and ask them to slightly change the icon. It will not be expensive, but the changed icon will be 100% unique. A designer, in turn, can provide you with all the necessary supporting documents.
